These Terms & Conditions (“Terms”) govern your use of thebrandforge.co.za (the “Website”) and all services offered by [ The Brand Forge (Pty) Ltd] (“Brand Forge”, “we”, “us”, “our”). By placing an order, paying an invoice, or using our Website, you agree to these Terms.

1) Who we are

2) Services we provide
Logo Design (concepts, revisions, final master files)
Website Design (WordPress builds, basic SEO setup, handover)
Company Profile / Pitch Deck Design (print-ready PDFs, optional editable files)
Related add-ons: stationery, social kits, brand sheets, copywriting, rush delivery, maintenance (if purchased)
A detailed scope for each project is defined in your package selection, quote, or order confirmation.
3) Quotes, packages & pricing
Quotes are valid for 14 days unless stated otherwise.
Prices are in South African Rand (ZAR)
We may update package pricing on the site at any time. Accepted quotes and paid orders are honoured at the agreed price.
4) Payments & milestones
For online checkout (WooCommerce): Full payment is taken at checkout via PayFast.
For quoted projects:
Standard milestone: 60% deposit to start, 40% before final delivery / website go-live.
For website projects above R10,000, we may use 40% / 40% / 20% (kickoff / design build / pre-launch).
Work begins only after we receive the deposit/checkout confirmation.
Invoices & receipts are issued electronically. You are responsible for any bank/merchant charges for your chosen payment method.
5) Turnaround & timelines (guidelines)
Timeframes assume content is supplied and feedback is returned within 48 hours per round.
Logo Design:
Concepts: 3–5 business days from brief.
Typical project: 5–7 business days (depends on revisions).
Website Design:
One-Pager: 7–10 business days
5-Page Starter: 10–15 business days
Business Plus (up to 10 pages): 15–20 business days
Company Profile:
First draft: 3–5 business days (Essentials/Professional) or 5–7 (Executive).
Delays in content, approvals, or payment will shift timelines. Rush options may be available (see Section 11).
6) Revisions & what’s included
Unless otherwise stated in your package/quote:
Logo Design packages
Basic: 2 concepts • up to 2 revision rounds
Standard: 2–3 concepts • up to 3 revision rounds
Pro: 3 concepts • up to 4 revision rounds
Websites: up to 2 rounds of consolidated feedback per page/template after first draft.
Company Profiles: as per package (e.g., Essentials 2 rounds, Professional 3, Executive 4).
A “revision round” is a single, consolidated list of change requests. Additional rounds or scope changes are billed as per Section 10.
7) Deliverables & file formats
Logos: AI (editable), PDF, PNG (transparent), JPG; SVG on Pro. Colour, mono, and reverse variants.
Websites: WordPress site with admin access, essential plugins, SSL, basic SEO (titles/meta/sitemap), and training handover.
Company Profiles: print-ready PDF + small (screen) PDF; optional editable file (Word/Google Docs/InDesign) if purchased.
Final deliverables are supplied via secure download link or cloud folder upon final payment.
8) Your responsibilities (client content & approvals)
Provide accurate content, copy, images, and brand assets with appropriate rights/licences.
Respond to proofs/queries within 48 hours to keep timelines.
Approve proofs carefully; your final approval authorises us to prepare deliverables/go live.
If the project is inactive for 30 days (no response), we may place it on hold; a rescheduling fee may apply when restarting.
9) Intellectual property & usage rights
You own the final approved logo/creative deliverables once full payment is received.
Working files (e.g., raw design files) are not included unless explicitly stated in your quote.
Third-party assets (e.g., stock images, fonts, icons) are licensed according to their vendor terms and are not transferred by us; you must hold appropriate licences for your use.
For websites, third-party plugin licences may be tied to our developer accounts; renewals or client-owned licences may be required after handover.
10) Out-of-scope changes & extra costs
Changes beyond the agreed scope (e.g., extra concepts, extra revision rounds, new pages/sections, copywriting, custom illustration, advanced SEO, third-party integrations) will be quoted and billed in addition to package fees. We will notify you and obtain written approval before incurring extra cost.
11) Rush work
Rush/priority scheduling is subject to availability and non-refundable once booked:
Logos: +R750 (24–48h concept prep, where feasible)
Company Profiles: +R950 (48h first draft, where feasible)
Websites: +20% of project fee for compressed timelines
12) Refunds & cancellations
Before we start (no concepts/drafts produced): 100% refund of fees paid, less payment gateway charges if any.
After concept/draft delivery: design time has been invested; no cash refunds. We may offer a credit or a reduced-scope alternative at our discretion.
Rush fees and any third-party costs (e.g., stock, printing, plugins) are non-refundable once purchased.
If you cancel, you retain no rights to preliminary work or unused concepts.
13) Acceptance, launch & handover
Logos/Profiles: On final approval and payment, we deliver master files.
Websites: We require final payment before go-live. After launch, we provide a [14-day] warranty window for bug fixes related to our work (content changes and third-party plugin conflicts excluded).
14) Maintenance & updates (web)
Ongoing updates, backups, security checks, and content changes are not included unless you purchase a maintenance plan. We recommend keeping WordPress, themes, and plugins updated to reduce security risks.
15) Portfolio & credits
We may display finished work (logos, screenshots, PDFs) in our portfolio, social channels, and case studies unless you request otherwise in writing before the project starts. We do not disclose sensitive/confidential information.
16) Confidentiality
We will keep your non-public information confidential and use it only for delivering the project. You agree not to disclose our proposals, proprietary processes, or non-public pricing.
17) Warranties & disclaimers
We warrant that our original work will not knowingly infringe third-party IP rights.
You warrant that all materials you supply (copy, images, logos, data) are owned by you or properly licensed.
Except as expressly stated, services and deliverables are provided “as is” without warranties of merchantability or fitness for a particular purpose.
18) Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of these Terms or our services is limited to the amount you paid us for the specific project giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits, data loss, or business interruption.
19) Force majeure
Neither party is liable for delays or failures caused by events beyond reasonable control (e.g., load-shedding, network outages, strikes, acts of God). Timeframes will extend reasonably to accommodate such events.
20) Privacy & data protection
Your personal information is processed in line with our Privacy Policy and South Africa’s POPIA (and GDPR where applicable). See /privacy-policy/ for details.
21) Third-party websites & services
We are not responsible for third-party websites or services linked from our Website, nor for their availability, content, or policies.
22) Governing law & disputes
These Terms are governed by the laws of South Africa. Disputes should first be addressed in good faith between the parties. If unresolved, the dispute may be referred to mediation or the Small Claims before any formal proceedings.
23) Changes to these Terms
We may update these Terms from time to time. The “Last updated” date indicates the most recent version. Material changes will be posted on this page.
